In the matter of D v A [2025] EWFC 66 (B), Sophie Kay represented the Mother at a multi-day Fact-Finding Hearing.

The Mother made serious allegations of domestic abuse against the Father concerning both her and the child. The allegations span across physical and emotional abuse to the Mother and child, along with coercive control.

The court found all five of the Mother’s overarching allegations proven. This highlights the significant extent of the risk of physical and emotional harm posed to the Mother and the child. In particular, the court found that the Father smacked and hit the child when the child made mistakes in his Maths homework.

This case serves as a useful reference for the judicial approach when considering cultural nuances in cases of coercive control and physical chastisement.

Whilst not set out in the judgment, remarkably, Sophie obtained a 100% costs order in favour of the Mother.
